The Federal Highway Administration (FHWA) has issued its long-awaited guidance on PPP, but because each state has different contracting methods, the direction is far short of specific. Even though the implementation of PPP recovery will be the state’s responsibility, there should be a principles-based approach that includes guardrails to prevent a state from going too far off the beaten path.

In an effort to provide these guardrails, the FHWA, along with AASHTO and ACEC, is preparing a set of FAQs to assist states and consultants in preparing their policies.

SN’s FAR and PPP experts clarify the many complexities associated with this subject matter.

During this webinar, we’ll review:

  • The technical application of the “credit clause.”
  • The states’ responsibilities to FHWA in the administration of federal funds.
  • The relationship between current contracts, contract negotiation, and cost recovery.
